William G. Tinker appeals a decision of the superior court affirming the denial of his compensation claims by the Alaska Workers Compensation Board (the Board). The Board denied one claim for failure to give timely notice, a second claim for failure to establish a prima facie case for compensation, and a third claim for failure to establish all elements of the claim by a preponderance of evidence, once the presumption of compensability had been rebutted. We affirm the decisions of the Board and the superior court as to the second and third claims, but reverse their decisions on the first claim. We hold that Tinkers failure to give notice should have been excused. We remand the case for further proceedings on this claim.
